Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and LancrLeads ("LancrLeads", "we", "us", or "our") governing your access to and use of the LancrLeads website, application, and related services (together, the "Service"). By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other organisation, you represent that you are authorised to accept these Terms on its behalf, and "you" refers to that organisation.

You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for business and professional use only, not for personal or household purposes.

LancrLeads lets you generate lists of publicly available local business information (such as business names, addresses, phone numbers, websites, and ratings) based on a category and location you choose. The data is collected from third-party sources and is provided on an "as is" and "as available" basis. We do not guarantee that results will be complete, accurate, current, or fit for any particular purpose.

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information, to keep it up to date, and to notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe. Each plan includes a set number of lead generations ("pulls") per billing period. Unused pulls do not roll over to the next period.

Your subscription renews automatically at the end of each period unless you cancel before the renewal date. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you retain access until then.

Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused pulls. We may change our prices on a prospective basis; we will give reasonable notice of any price change, which will apply to your next renewal.

You are solely responsible for how you use the data obtained through the Service. You agree to comply with all applicable laws and regulations, including data-protection law (such as the GDPR), and anti-spam and electronic-marketing rules (such as the ePrivacy Directive and equivalent national laws) when you contact the businesses or individuals you find.

You agree not to:

(a) use the Service for any unlawful, deceptive, or harmful purpose; (b) resell, redistribute, or sublicense the Service or bulk data except as expressly permitted; (c) attempt to gain unauthorised access to the Service, scrape or overload our systems, or circumvent usage limits; or (d) use the Service in a way that infringes the rights of others.

The Service, including its software, design, and branding, is owned by LancrLeads and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Subject to your compliance with these Terms, you may use the lead data you generate for your own legitimate business purposes.

The Service relies on third-party providers (for example, for payments, hosting, email, authentication, and data collection). Your use of those providers may be subject to their own terms, and we are not responsible for their acts or omissions.

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, LancrLeads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for intent or gross negligence.

These Terms apply for as long as you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Provisions that by their nature should survive termination (such as those on intellectual property, disclaimers, and liability) will continue to apply.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app). Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of your country of residence remain unaffected.
